Oddle Marketing Terms of Service

Introduction
These Terms and Conditions govern the use of Oddle’s Email Marketing Subscription Plans and Broadcast Credit Packages (collectively, the “Email Services”). By subscribing, purchasing, or using the Email Services, you agree to comply with these terms. These Terms are specific to Oddle Email Marketing and are subject to the overarching Master Agreement governing your use of Oddle’s services. In case of any conflict, the Master Agreement shall prevail.

Acceptable Use of Email Services
By using the Email Services, you agree to the following (“Email Services Requirements”):
- You will only send emails to recipients who have explicitly opted in to receive messages from you.
- You will not use purchased, rented, or third-party email lists.
- You will not send emails to generic or role-based addresses (e.g., info@domain.com or webmaster@domain.com).
- Every email must include:
- A working “unsubscribe” link that allows recipients to opt out;
- Your valid physical mailing address;
- A link to your current privacy policy.
- You will not manipulate headers, sender names, or subject lines in a misleading or deceptive manner.
- You will not include content that violates applicable laws, including but not limited to content that is obscene, defamatory, hateful, infringing, or related to gambling, terrorism, or illegal activities.
- You will not send emails that encourage recipients to forward chain messages or incentives.

Compliance and Content Monitoring
- Oddle reserves the right to monitor outbound emails for compliance, including scanning content for spam, phishing, or other prohibited material.
- Oddle may suspend or terminate your access to the Email Services if non-compliance is suspected or confirmed.
- You are solely responsible for understanding and complying with all applicable laws (e.g., CAN-SPAM, GDPR, PDPA).
- You will use reasonable efforts not to send sensitive personal data through the Email Services (e.g., health, religious, political, or racial information).

Third-Party Providers
Oddle’s Email Services utilize third-party providers, including Postmark (a service by ActiveCampaign). Your use of the Email Services is subjected to Postmark’s Terms of Use, as it may be amended by Postmark from time to time.

Monthly Subscription Plans
All Monthly Subscription Plans include:
- Monthly broadcast credits
- Unused credits rollover, capped at 4x your plan limit
- Unlimited sender profiles and customer contacts
- Customer targeting with segments and filters
- Access to restaurant-friendly email templates
- Performance reporting & analytics
- Post-paid billing at the end of each calendar month
- Credits usable across any brand in your Oddle account

Credit Packages
Oddle also offers one-time Broadcast Credit Packages with no expiration date. These packages include:
- Permanent credits with no expiry
- Unlimited sender profiles and customer contacts
- Advanced targeting and filtering
- Performance analytics
- Usability across all brands in your Oddle account

Credit Rollover
- For Monthly Subscription Plans, unused credits roll over each month, up to a maximum of 4x your plan’s limit.
- Credit Packages do not have rollover limits, as they do not expire.

Overages
- If you exhaust all your credits, additional credits will be automatically topped up in increments of 1,000 credits to ensure uninterrupted email sending.
- Overages are charged based on your plan’s overage rate per 1,000 credits.
- Charges for overages are included in your monthly invoice.

Billing & Payments
- Subscription Plans: Billed post-paid at the end of each calendar month.
- Credit Packages: Billed immediately at the time of purchase.
- All charges are processed according to your registered payment method.

Upgrades, Downgrades, and Cancellations
- Upgrades: Can be made at any time. Additional credits are applied immediately. Billing will reflect the highest plan subscribed to during the billing cycle.
- Downgrades: Accumulated credits remain valid. The downgrade takes effect the following month.
- Cancellations: You may cancel anytime. The plan remains active until the end of the billing cycle, and all credits follow the standard rollover rules.

Modifications to Terms
Oddle reserves the right to update these Terms and Conditions at any time. Changes will be posted on our website. Continued use of the service after such changes constitutes your acceptance of the updated terms.
