Terms of Service – AI Products

Effective as of 15 January 2026

These AI Product Terms (“Product Terms”) supplement the Oddle Terms of Service (“Platform Terms”) and govern your use of Oddle’s AI-powered products, features, and tools. By using Oddle’s AI Products, you agree to be bound by both these Product Terms and the Platform Terms. The Platform Terms are incorporated herein by reference. In the event of any inconsistency between these Product Terms and the Platform Terms concerning AI Products, these Product Terms shall prevail.

1. AI PRODUCTS

  1. We may offer products, features, or tools as part of the Services that are powered by artificial intelligence (generative or otherwise), machine learning, or similar technologies (collectively, “AI Products”). The terms in this section govern your use of the AI Products within the Services provided by Oddle, but not third parties or affiliates.

  2. If the AI Products are provided as a beta service, the appropriate terms in the Agreement also apply. Some of the AI Products in your account may be toggled on or off by default; you can adjust these settings at any time in your Merchant Account.

2. INPUT AND OUTPUT

  1. If you submit or upload any text, images, or other content to the AI Products (“Input”), you are responsible for the Input as well as the text, images, or other content generated by the AI Products based on your Input (“Output”).

  2. You will ensure that your use of the AI Products, including Input and Output, complies with the Agreement and with applicable law.

  3. You acknowledge that:

    1. except to the extent it is Customer personal data, Input will not be treated as Confidential Information. You should not include any data or information in your Input that is personal information, sensitive personal information, or information that you are restricted from using or sharing (for example, third party confidential information);

    2. Output will not be Confidential Information (except to the extent it contains Customer personal data); and

    3. Output may not be accurate or reliable. You should independently review all Output before using or sharing it.

3. OWNERSHIP AND RIGHTS

  1. Between you and Oddle, you retain all rights you may have to use and exploit your Input.

  2. Oddle and its affiliates and licensors retain all ownership in and to the AI Products and Output, including but not limited to all algorithms, models, and aggregated results of developing the AI Products.

  3. You hereby grant us a sub-licensable, non-exclusive, fully paid-up, royalty-free licence during the term of the Agreement to copy and use any Input you provide in connection with the AI Products.

  4. Subject to your payment of all applicable fees for the Service, Oddle hereby grants you a non-exclusive, non-sublicensable, royalty-free licence during the term of the Agreement to use and display the Output solely as a part of the Services.

  5. You acknowledge that Output may not be unique across users and that the AI Products may generate the same or similar Output for you or another party. For example, you may provide Input into an AI Product such as “Write a description for my restaurant” and receive responses that are similar to those provided to other merchants. These responses are not unique to you and you may not claim ownership in them.

4. AI SERVICE PROVIDERS

  1. We provide elements of the AI Products through third party service providers (“AI Service Providers”). You acknowledge that your Input will be shared with and processed by our AI Service Providers, to enable your use of our AI Products, for content moderation, and other business purposes consistent with this Agreement.

  2. You may not use the AI Products in a manner that violates any terms or policy of any AI Service Provider.

5. AVAILABILITY AND MODIFICATIONS

  1. We do not guarantee the availability of the AI Products in any or all geographical areas. There may be production downtime impacting the AI Products that results from a failure of a third party service provider.

  2. Notwithstanding anything to the contrary in the Agreement or these Product Terms, we may make changes to the AI Products that materially reduce the functionality provided to you during the Term or change the limits that apply to you at any time in our sole discretion. We will use reasonable endeavours to notify you of material changes that may affect your use of the AI Products.

6. RESTRICTIONS

  1. In addition to the restrictions set out in the Acceptable Use Policy, you shall not use the AI Products to:

    1. generate content that is illegal, harmful, abusive, defamatory, obscene, or otherwise objectionable;

    2. generate content that infringes the intellectual property rights or privacy rights of any third party;

    3. impersonate any person or entity, or misrepresent your affiliation with any person or entity;

    4. generate spam, phishing content, or other unsolicited communications;

    5. attempt to reverse engineer, decompile, or extract the underlying models, algorithms, or training data of the AI Products;

    6. use the Output to train, develop, or improve any competing AI or machine learning models; or

    7. circumvent any technical limitations or safety measures implemented in the AI Products.

7. DISCLAIMERS

  1. The AI Products are provided “as is” and “as available”. To the maximum extent permitted under applicable laws, we make no guarantee, representation, or warranty:

    1. regarding the accuracy, completeness, reliability, or fitness for a particular purpose of any Output;

    2. that the AI Products will be error-free, uninterrupted, or free from harmful content;

    3. that the Output will not infringe the intellectual property or other proprietary rights of any third party; or

    4. that the AI Products will meet your specific requirements or expectations.

  2. You are solely responsible for evaluating and verifying the suitability and accuracy of any Output before relying on, using, or sharing it. Oddle shall not be liable for any decisions or actions taken based on Output generated by the AI Products.
