Oddle Marketing Terms of Service

1. Introduction

These Terms and Conditions govern the use of Oddle’s Email Marketing Subscription Plans and Broadcast Credit Packages (collectively, the “Email Services”). By subscribing, purchasing, or using the Email Services, you agree to comply with these terms. These Terms are specific to Oddle Email Marketing and are subject to the overarching Master Agreement governing your use of Oddle’s services. In case of any conflict, the Master Agreement shall prevail.

2. Acceptable Use of Email Services

By using the Email Services, you agree to the following:

  • Only send emails to recipients who have explicitly opted in to receive messages from you.
  • Do not use purchased, rented, or third-party email lists.
  • Avoid sending emails to generic or role-based addresses (e.g., info@domain.com or webmaster@domain.com).
  • Each email must include:
    • A working “unsubscribe” link;
    • Your valid physical mailing address;
    • A link to your current privacy policy.
  • Do not manipulate headers, sender names, or subject lines in a misleading way.
  • Do not include content that violates laws (e.g., obscene, defamatory, illegal, or infringing material).
  • Do not send chain messages or incentives encouraging email forwarding.

3. Compliance and Content Monitoring

  • Oddle reserves the right to monitor outbound emails for compliance, including scanning for spam, phishing, or prohibited content.
  • Oddle may suspend or terminate your access if misuse or non-compliance is detected.
  • You are responsible for complying with all applicable laws (e.g., CAN-SPAM, GDPR, PDPA).
  • Do not send sensitive personal data (e.g., health, religion, political beliefs) through the Email Services.

4. Third-Party Providers

Oddle’s Email Services utilize third-party providers, including Postmark (a service by ActiveCampaign). Your use of the Email Services may be subject to Postmark’s Acceptable Use Policy, as it may be amended from time to time.

5. Monthly Subscription Plans

All Monthly Subscription Plans include:

  • Monthly broadcast credits
  • Unused credits rollover, capped at 4× your plan limit
  • Unlimited sender profiles and customer contacts
  • Customer targeting with segments and filters
  • Access to restaurant-friendly email templates
  • Performance reporting & analytics
  • Credits usable across any brand in your Oddle account

6. Credit Packages

Oddle also offers one-time Broadcast Credit Packages with no expiration. These packages include:

  • Permanent credits with no expiry
  • Unlimited sender profiles and customer contacts
  • Advanced targeting and filtering
  • Performance analytics
  • Usage across all brands in your Oddle account

7. Credit Usage and Rollover

Merchants are entitled to send up to the greater of:

  • The monthly credit limit of their current subscription plan, or
  • Their accumulated balance of unused credits (the “credit bank”)

Unused credits from active subscriptions roll over month to month, up to a maximum of 4× your monthly plan limit.

⚠️ You will not be able to use your accumulated credits if your subscription has ended or is inactive. Access to the Email Services — including the use of credits — requires an active, paid subscription.

8. Overages

  • If you exceed your available credits (monthly limit or credit bank), we will automatically top up your account in increments of 1,000 credits to ensure uninterrupted sending.
  • Overages are billed using your plan’s applicable overage rate.
  • Overage charges will be billed in the following month’s invoice.

9. Billing & Payments

  • Subscription Plans are billed in advance at the start of each calendar month.
  • Credit Packages are billed immediately at the time of purchase.
  • Overage charges (if any) are billed in the following month’s invoice.
  • All charges will be processed through your registered payment method.
  • Access to any credits is conditional on maintaining an active subscription. If your subscription ends or is cancelled, all unused credits — including rollover — will be forfeited.

10. Upgrades, Downgrades, and Cancellations

  • Upgrades: Can be made at any time. Additional credits are applied immediately. Billing reflects the upgraded plan from the next billing cycle.
  • Downgrades: Take effect the following month. Existing credits remain valid, subject to rollover limits.
  • Cancellations: You may cancel anytime. Your subscription remains active until the end of the billing cycle. Any unused credits will be forfeited at the end of that period.

11. Modifications to Terms

Oddle reserves the right to update these Terms at any time. Any changes will be posted on our website. Continued use of the service after such changes constitutes your acceptance of the revised Terms.
